Terms of Service

1. Acceptance of terms

By creating an account on Mubrary ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. Mubrary is currently operated by Aybars Mavi as an individual, not through a registered company.

2. Where we operate

Mubrary is intended for use by, and directed at, residents of the United States. We design and operate the Service to comply with U.S. law. We do not direct or specifically target the Service to users in any other country — including the European Union, United Kingdom, Canada, or Australia — even though the Service may be technically accessible there. If you access Mubrary from outside the United States, you're welcome to use it, but you do so on that basis.

3. Eligibility

You must be at least 13 years old to create an account. By signing up you confirm you meet this requirement, in compliance with the U.S. Children's Online Privacy Protection Act (COPPA).

If you are under the age of 18 (or the age of majority where you live, if older), you may only use Mubrary with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

4. Your content

You retain ownership of the ratings, posts, and comments you submit ("User Content"). By posting User Content, you grant Mubrary a worldwide, non-exclusive, royalty-free license (including the right to sublicense to our hosting and infrastructure providers) to host, display, and distribute it as part of operating the Service (e.g. showing your ratings to people who follow you). This license ends when you delete the content or your account, except for backup copies kept as described in the Privacy Policy.

You are solely responsible for your User Content. Don't post anything illegal, infringing, harassing, or that violates someone else's rights.

5. Music catalog data

Album, artist, and track metadata (names, MusicBrainz identifiers, and relationships) is sourced from the MusicBrainz open database under its CC0 public domain dedication. Some supplementary data we use, including genre tags, is sourced under MusicBrainz's CC BY-NC-SA license, which restricts commercial use — this may need review if Mubrary introduces paid features or advertising. Cover art is provided by the Cover Art Archive (operated by the Internet Archive) at the uploader's own risk and without a guaranteed per-image license; we do not independently verify or claim ownership of this artwork.

6. Conduct & moderation

We may remove content, suspend, or terminate accounts that violate these Terms, harass other users, or abuse the blocking/reporting systems. To report a post, comment or profile, open the ⋯ menu on it and choose Report. See our DMCA Policy for copyright takedown requests.

Intimate images shared without consent. If an intimate image or video of you (including one that is AI-generated or digitally altered) was posted on Mubrary without your consent, you can ask us to remove it. You do not need a Mubrary account. Email aybarsmv@gmail.com with the subject "Intimate imagery removal request" and include: your physical or electronic signature; the URL, or enough detail for us to locate the material; a statement that you believe in good faith that the image or video was shared without your consent; and your contact information. We will remove verified material within 48 hours of receiving a valid request and make reasonable efforts to remove known identical copies.

We report apparent child sexual abuse material to the National Center for Missing & Exploited Children as required by law, and we may remove such content and terminate accounts without notice.

7. Termination

You may delete your account at any time from your profile settings, which permanently removes your ratings, posts, and personal data as described in our Privacy Policy. We may suspend or terminate accounts that violate these Terms.

8. Disclaimers & liability

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied — including, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be accurate, secure, uninterrupted, or error-free.

We are not responsible for the content, conduct, or accuracy of other users, or for the availability, accuracy, or reliability of third-party services the Service depends on, including MusicBrainz, the Cover Art Archive, Supabase, Vercel, and Resend.

The Service links to and displays content from third parties, such as news articles, Spotify, MusicBrainz and the Cover Art Archive. We do not control and are not responsible for third-party sites or content, and you use them at your own risk and subject to their terms.

You are solely responsible for your interactions with other users. Mubrary is not a party to, and is not liable for, disputes or harm arising between you and another user — including fraud, scams, or harassment. Use caution before sharing personal or financial information with other users, and report suspected abuse using the Service's reporting tools.

To the maximum extent permitted by law: (a) Aybars Mavi is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, and (b) Aybars Mavi's total liability to you for any claim arising out of or relating to the Service will not exceed $100, regardless of the legal theory the claim is based on.

We may modify, suspend, or discontinue the Service, in whole or in part, at any time, without liability to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Aybars Mavi from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or of any third party's rights.

10. Changes to these terms

We may update these Terms from time to time. When we make material changes, we may ask you to review and accept the updated Terms before you continue using the Service. Continued use of the Service after changes take effect also means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of Türkiye.
